Thomas P. Miller Explains What He Heard at the Oral Arguments of King v. Burwell

Although the Supreme Court oral arguments of King v. Burwell mostly went the way people were expecting, there were a few surprises, said Thomas P. Miller, JD, resident fellow at the American Enterprise Institute, who was able to sit in the courtroom the day of the arguments.

At this point, the decision will come down to which side of the arguments Chief Justice John Roberts and Justice Anthony Kennedy fall, he said.

"It's always hard to predict from an oral argument, and you get all those ... warnings not to assume what they ask about will ultimately be in their opinion," Mr Miller explained.
